NO PURCHASE OF GOODS OR SERVICES OR PAYMENT OF ANY FEES IS NECESSARY OR PERMITTED TO ENTER A COCLT HOMEBUYER SELECTION DRAWING. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Central Ohio Community Land Trust Corporation (COCLT) (the “Sponsor”) as final in all matters relating to this Drawing.

Entrants must be 18 years of age or older to participate and a resident of Franklin County, Ohio at the time of entry. Participation in the COCLT Orientation Session and completion of the COCLT Questionnaire is required in order to be eligible to enter the drawing.

The Drawing is sponsored by Central Ohio Community Land Trust Corporation (COCLT), 845 Parsons Avenue, Columbus, Ohio, 43206 (“Sponsor”).

The Drawing is administered by an independent, third-party selected by the COCLT.

By entering, the Drawing Participant indicates full and unconditional agreement to (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. 

No purchase or payment is necessary or permitted to enter or win. Drawing Participants for each COCLT Development Drawing will be entered into the drawing by participating in the COCLT Orientation Session and completing the COCLT Questionnaire indicating which Development Drawings they wish to participate.

The Drawing will be conducted on an assigned business day by the Drawing Administrator. Official results will be made available the next business day by 5 p.m. Eastern Time. 
On the day of the drawing, the Drawing Administrator will draw a number for every Drawing Participant in the Development Queue. The odds of being selected depend on the number of Drawing Participants in the Homebuyer Selection Drawing for each development project.

Sponsor will notify all drawing participants by phone or email to the email address associated with their COCLT questionnaire within two (2) business days after the drawing takes place. Participants will be notified of their number on the Buyer List that is created after the drawing takes place. The COCLT staff  will notify drawing participants who have the lowest numbers in the drawing that they are now being  placed in an active buyer status and will begin working with those participants to start the required steps to homeownership eligibility. 

If a drawing participant fails to respond within 10 business days from the date of notice to become an  Active Buyer, the COCLT will remove the participants name from the buyer’s list and participant will forfeit any further participation in the current project development process.

Receiving a low number in the Homebuyer Selection Drawing does not complete all the eligibility requirements to acquire a COCLT home. The low number in the drawing allows the Drawing Participant to become an Active Buyer with the COCLT. The Active Buyer will work towards completing the remaining required homeownership eligibility steps within the required timeframes to become a qualified buyer for  a COCLT home.
Active Buyers agree to complete the following:

•    Schedule an appointment with and submit all necessary paperwork to the COCLT designated HUD                approved counseling agency to complete the COCLT income eligibility determination. All households            must be 120% or below the area median income to be income eligible for a COCLT home.
•    Select and work with a realtor.
•    Receive pre-approval for a leasehold interest mortgage loan with a COCLT approved lender.
•    Complete a homebuyer education course through a Housing and Urban Development (HUD)-approved         counseling agency.

In the event that the operation, security, or administration of the Drawing is impaired in any way for any reason, Sponsor may, in its sole discretion suspend the Drawing to address the impairment and then resume the Drawing in a manner that best conforms to the spirit of these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the option to pursue all remedies available to Sponsor. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail or email shall not be deemed proof of receipt of that communication by Sponsor. Email addresses will be collected for future communication by the Sponsor.

Drawing Participants agrees to release and hold harmless Sponsor, its parent company (COCIC), affiliates, and its officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Drawing including, but not limited to: (a) unauthorized human intervention in the Drawing; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Drawing or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Drawing. Participant further agrees that Sponsor is not responsible for any loss incurred by entrant for any reason whatsoever. Each Drawing Participant that becomes an Active Buyer is responsible for meeting COCLT land lease requirements, financing requirements, and all federal, state, local, and municipal laws, and regulations. The Drawing will be governed by the laws of the State of Ohio.

Any information submitted as part of the Drawing will be used for purposes of this Drawing and treated in accordance with Sponsor’s Privacy Policy. Except where prohibited, participation in the Drawing constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information for promotional and administrative purposes in any media without further payment or consideration.

Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Drawing, shall be governed by, and construed in accordance with, the laws of the State of Ohio.
